1. Acceptance of Terms

By accessing or using MastermindAssistant.ai ("the Service"), operated by The Namers ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

MastermindAssistant.ai is an AI-powered course analysis and creation tool that integrates with Learning Management Systems (LMS) such as Moodle, Totara, Canvas, and Blackboard. The Service provides course recommendations, quiz generation, assignment creation, and other AI-assisted features via a plugin and API.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials, including your API key. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to generate harmful, misleading, or inappropriate content.
• Exceed your subscription plan's usage limits or circumvent rate limits.
• Share, resell, or redistribute your API key or access credentials to third parties.

5. Subscription Plans and Billing

The Service is offered through subscription tiers (Explorer, Pro, Ultra, and Custom/Enterprise). Each tier includes specific monthly usage quotas. Fees are billed on a recurring monthly basis through our payment provider.

You may upgrade or downgrade your plan at any time. Downgrades take effect at the start of the next billing period. We reserve the right to change pricing with 30 days' notice.

6. API Usage and Quotas

Each subscription tier includes defined monthly quotas for AI features (course recommendations, quiz generation, assignment generation, page content generation, and course creation). Usage beyond your quota will be blocked until the next billing period begins, unless otherwise arranged under a Custom plan.

We enforce per-minute rate limits to ensure fair access for all users. Abuse of rate limits may result in temporary or permanent suspension of your account.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. The plugin uses anonymized identifiers only — no personal or identifiable learner information is shared with our servers or with third-party AI providers.

We may log anonymized request metadata (endpoint, model, token counts) for service improvement and training data purposes. No personal data is included in these logs.

8. Intellectual Property

All content, trademarks, and technology associated with the Service are owned by The Namers. You retain ownership of any content you create using the Service (e.g., generated quizzes, assignments, and course materials). We do not claim ownership over AI-generated outputs produced for your use.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, The Namers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

AI-generated content is provided as suggestions and should be reviewed by educators before use. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated output.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activity that harms the Service or other users. You may cancel your account at any time by contacting us. Upon termination, your access to the Service will cease and any remaining subscription period will not be refunded.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which The Namers operates. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.
